Overview

An interactive session designed to facilitate discussion about, and find solutions for, the real-life problems that property litigators face when other property professionals haven't done their jobs properly:

  • Sloppy surveys, valueless valuations, dodgy drafting, shoddy notices and turning a blind eye - when is the work of a property professional so bad it's wrong?
  • Playing the market. How do you size the loss?
  • The customer's not always right. When does the client have to share the blame?


Speakers

Joanne Wicks QC

The primary focus of Joanne's practice is property litigation and related professional liability. She has been instructed on some of the most complex and challenging cases in her field and by clients who are household names. Her strength is the ability to combine intellectual rigour with a good understanding of her clients' commercial interests and a determination to find the best way to serve them. She has been described in The Legal 500 as "an incredible fighter" with "effective, unflappable advocacy" and "a very good court manner". Joanne is also recommended in Chambers and Partners for being "enthusiastic, understanding and efficient". Joanne is well-known for her seminars and lectures and is an editor with, Jonathan Davey, of Butterworths' Property Law Handbook.

Jonathan Davey

Jonathan has a broad practice with a particular emphasis on property, professional liability and commercial disputes. He is an experienced advocate, regularly appearing in the High Court, County Courts and a wide range of tribunals including both the First and Upper Tiers of the new Tribunal system. Jonathan's clients range from individuals to corporate entities to government departments. Jonathan is on the Panel of Counsel to the Crown (C Panel) and in that capacity regularly acts in property related matters for among others the Ministry of Defence, the Ministry of Justice and the Highways Agency. Jonathan recently appeared before the Court of Appeal as junior to Michael Barnes QC in BDW Trading Ltd (t/a Barratt North London) v JM Rowe [2011] EWCA Civ 548 (rights of property developer to rescind contract for sale of commercial property during downturn in market following financial crisis). Jonathan is the joint editor with Joanne Wicks QC of Butterworths' Property Law Handbook (new edition due out in autumn 2011).

James Walmsley

James has been a tenant at Wilberforce since 2008 and has a broad commercial and chancery practice. This includes work on professional negligence and property-related matters. He has extensive experience both in Court (at all levels Court of Appeal and below) and in arbitrations. He does a mix of led work and work on his account, and regularly gives talks.
