Hertsmere Borough Council v. Lovat

The Court of Appeal overturned a decision of Judge Dight in the Central London County Court by which he had held that Mrs Lovat was entitled to acquire the freehold of her house in Shenley Park, Hertfordshire, under the Leasehold Reform Act 1967. Joanne Wicks QC successfully argued that Mrs Lovat's tenancy was an "excluded tenancy" under s.1AA of the 1967 Act and that the Judge's approach to interpretation of that section produced anomalies which could never have been Parliament's intention when it was enacted.
