Ross River Ltd & Anor v Cambridge City Football Club [2008] EWCA Civ 772

This case centred upon allegations of bribery against the Chairman of Cambridge City Football Club. It was alleged that the Chairman had sold the football ground at a gross undervalue as a result of receiving a £10,000 bribe and also on account of a fraudulent misrepresentation. Although the Court was prepared to set aside an overage agreement entered into between the Club and the developer purchaser, it did not set aside the original sale agreement. The decision involved extensive consideration of fiduciary obligations under overage agreements, inducement and the law of bribery.
