Christopher has extensive experience of all aspects of pensions work, both litigation and advisory. He acts for trustees, employers and members of pension schemes and has acted on several appeals for the Pensions Ombudsman. He has recently been acting for the DWP (Department for Work and Pensions).
He has advised trustees and employers in relation to many of the largest schemes; and has advised the Ministry of Defence on the Armed Forces Compensation Scheme, and the Pensions Regulator on its powers under the Pensions Act 2004.
Recent and notable cases include:
- Acted for DWP intervening in the Court of Appeal on whether a scheme provides money purchase benefits: Bridge Trustees v Yates. [2009]
- Acted for DWP intervening in the Court of Appeal on whether partial buy-outs of GMPs are permissible: Eastearly v Headway. [2009]
- Acted for members in appeal as to whether rule in Hastings-Bass could be used to correct mistakes in a trust deed and rules: Smithson v Harrison. [2008]
- Acted for 'target' in attempt by the Pensions Regulator to impose liability on the owners of a pension scheme to support the scheme through a Financial Support Direction: Focus/ Do-it-All. [2008]
- Acting for members in proceedings in relation to deficits in the Pilots' National Pension Fund. [ongoing]
- Acting for trustees in relation to the Merchant Navy Ratings Pension Fund. [ongoing]
- Acted for National Power in successful appeal to the House of Lords in relation to the use of surplus: National Grid v Mayes. [2001]
- Acted for insurance company in Court of Appeal successfully challenging jurisdiction of Pensions Ombudsman: R (Britannic Asset Management) v Pensions Ombudsman. [2002]
- Acted for Department of Health in successful appeal to the Court of Appeal against Ombudsman decision on index-linking of public sector pensions: Department of Health v Moss. [2000]
- Acted for administrators in relation to deficits in the T&N fund: Re T&N. [2004]
- Acted for representative member in relation to the Railways Pensions Scheme: SWT v Wightman. [1998]
