Clare is highly regarded as a trust specialist. She has considerable experience in probate disputes and claims under the 1975 Act, however much of her recent work has involved hostile trust litigation and asset tracing in relation to complex offshore structures. She appeared in the House of Lords in the leading modern case on asset tracing (Foskett v McKeown [2001] 1 AC 102 (HL)).
Until recently, she was a joint editor of Glasson's International Trust Laws.
Recent trust cases include:
Birley v Birley & others [2008-9] (probate dispute; acted for the Executors of the estate of the late Sir Mark Birley).
Re Weissfisch [2004-9] (multi-party hostile trust litigation in Bahamas).
Kensington v Montrow (British Virgin Islands) [2007 - 2008] (off-balance sheet assets notionally held by charitable purpose trust; claim was that a Jersey/BVI loan securitization trust structure was a sham to defeat creditors).
Gregson v HAE [2007] (dog-leg claim against directors of corporate trustee alleging negligent breach of trust for failure to diversify trust assets).
Re Jersey Trusts [2007] (€50 million; trustees' negligence claim).
