Clare specialises in professional liability claims against solicitors, accountants, brokers and trustees. Current cases include: claim against director for negligent and fraudulent management of company's affairs, claim against accountants for negligent overvaluation of goodwill in context of incorporation of business, claim against solicitors for failed litigation.
Recent cases include:
Bank of Tokyo-Mitsubishi v Baskan Gida and others [2009] EWHC 1276 (Ch) (€30 million; negligent misstatement in trade reference, scope of SAAMCO cap, contributory negligence).
Attorney General for Zambia v Meer Care & Desai & others (US$60 million fraud claim, but professional liability issues were whether the defendant 'firm' was a sole practitioner or a partnership, and whether the purported partner was vicariously liable).
Gregson v HAE [2007] (dog-leg claim against directors of corporate trustee alleging negligent breach of trust for failure to diversify trust assets).
Re Jersey Trusts [2007] (€50 million; trustees' negligence claim).
MFI v Clifford Chance [2006] (acted for defendant solicitors in negligence claim arising out of pensions equalisation).
Fryett v Revill Pearce [2005] (accountant's negligence claim alleging giving of negligent tax advice).
