Daniel has wide experience in professional liability matters involving different professionals, including accountants, solicitors, barristers, surveyors, trustees and actuaries.  Many of these disputes have been resolved by alternative dispute resolution and are accordingly confidential.

Reported cases include:

  • Simpson Curtis Pension Trustees v Readson (pension trusts, administrative receiver, power of appointment, actuarial negligence).

  • Midland Bank Trust Company (Jersey) v Federated Pensions Services, Jersey (breach of trust, scope of trustee exemption clause).

  • Corbett v Bond Pearce, (solicitors' negligence, will drafting).

  • Perotti v Iliffes Booth Bennett, (barristers' negligence, conduct of litigation).

Other cases include:

  • Acting for trustees defending a claim that trust monies were mistakenly paid to someone who had not been appointed as a beneficiary of the trust, and who subsequently became insolvent.

  • Acting for the managers of a hedge fund in proceedings against accountants and offshore trustees in connection with the consequences of a defective or defectively implemented tax planning scheme.

  • Acting for the director of a private company against solicitors in connection with the giving of negligent advice as regards tax.

  • Acting for solicitors defending a claim concerning the negligent drafting, as part of the resolution of a complex dispute, of a right of pre-emption over land.

  • Acting for the trustees of  an offshore trust in connection with claims against solicitors and accountants regarding defective tax planning.
