Litigation

Examples of international and offshore litigation in which Emily has recently been involved are:

  • A multi-million pound dispute in Jersey concerning the administration of trusts for a prominent Saudi family.

  • An application pursuant to the Cayman Islands equivalent of the Trustee Act 1925, section 57 for the purposes of the partition of a large family trust.

  • An application to the English Court to vary the trusts of a Settlement with offshore trustees and beneficiaries, giving rise to Canadian tax and insurance issues.

Advisory

Emily regularly advises trustees and beneficiaries of trusts with offshore trustees and beneficiaries, including on issues of UK tax. She also regularly advises in relation to conflict of laws issues concerning estates with a foreign element. She is experienced in interpreting foreign law and tax advice.

Examples of recent advisory work include:

  • Advising the trustees of a trust which had been offshore in relation to potential tax charges on remitting income and capital to the UK;

  • Advising on conflict of laws issues concerning the enforcement of Swiss udgments in the UK.

  • Advising in relation to issues arising out of the ownership by a deceased person of property in Spain.

  • Advising in relation to a divorce where one spouse was the beneficiary of an offshore trust and the doctrine of 'judicious encouragement'.

  • Advising on how to regularise the trusteeship of an offshore trust where there were doubts as to the validity of historic appointments and retirements.
