Emily acts for clients in a range of disputes concerning companies, partnerships, and unincorporated associations.
Her recent experience includes:
- Acting in a long-running dispute concerning the scope of a director's powers in relation to the management of a property investment company.
- Representing the defendant in a claim concerning a dispute between the members of an unincorporated association. The case concerned issues of the scope of the management committee's powers, allegations of conflict of interest, and the validity and effect of resolutions passed by members' votes (with John Martin QC).
- Acting for the defendant in a partnership dispute involving complex requests for accounts and inquiries.
- Representing an applicant seeking a validation order under section 127 of the Insolvency Act 1986 in relation to a sale of commercial property and the satisfaction of outstanding debts.
- Acting for the Pensions Regulator in prohibition proceedings concerning an individual holding directorships and pension trustee positions in a multi-national corporate organisation (with Michael Tennet QC and Jonathan Hilliard).
- Advising minority shareholders on issues of unfair prejudice and derivative actions.
