Emily has a strong interest in all areas of work with an international or offshore element. Matters in which she has recently been involved include:

  • A dispute concerning competing entitlements to the estate of a deceased man domiciled in the Isle of Man. The case involved:
    • conflicts of laws and jurisdiction issues relating to succession under both the English and Isle of Man Inheritance (Provision for Family and Dependants) Acts;
    • allegations of breach of trust relating to dealings with the proceeds of sale of several properties previously owned by a family company;
    • survivorship to monies held in joint bank accounts;
    • allegations of proprietary estoppel.

  • A commercial dispute concerning the provision of services by two companies based in Gibraltar and Dubai to facilitate the sale of a £170m property owned by the government of Dubai to an Isle of Man trust established by a Ukrainian national. The matter is due to go to trial in 2012. In June 2011 Emily successfully resisted an application for security for costs against the offshore claimant companies.

  • A dispute between two Russian nationals concerning complex business transactions conducted through a number of English and offshore companies. Emily was involved in contested proceedings to wind up Gatnom Capital & Finance Limited, an English company. She also successfully obtained a non-party costs order against the sole director of Gatnom Capital & Finance in relation to costs incurred during proceedings to revoke a fraudulently-induced CVA (In the matter of Gatnom Capital, 29 November 2011, unreported, before Newey J).

Emily has also worked in the contentious trusts department of a leading Jersey-based law firm.
