James regularly advises in both commercial and residential property related matters and appears in court at both trial and the interlocutory stage. Prior to pupillage James spent some time working in the legal team at The Crown Estate and is familiar with some of the recondite issues that can arise in that context. During pupillage James sat with, amongst others, Martin Hutchings and Rupert Reed and gained wide exposure to a wide range of matters including restrictive covenant modification and dilapidations. Cases include:
- Ravengate Estates Ltd v Horizon Housing Group & Anor [2007] EWCA Civ 1368 with Martin Hutchings (when pupil)
- Advising on a wide range of issues relating to (to take some random recent examples) the interpretation of service charge clause, interpretation of an exclusivity agreement in the context of a residential transaction, and rent charges.
- Advising in relation to a range of issues relating to easement interference, including in relation to the remedying of an interference caused by an unknown third party.
- Successfully gaining summary judgment for Thames Water on a large claim for unpaid rent in the face of a defence based on estoppel by convention in the context of a complex network of agreements.
- Numerous case management appearances in commercial lease and dilapidations matters.
- Numerous court appearances in residential tenancy, mortgage and trespasser possession matters.
