Joanne's real property practice includes easements, restrictive covenants, land registration and adverse possession. She advises on and litigates disputes arising out of development agreements, joint venture and other contracts and about equitable interests in property.

In the commercial landlord and tenant field, Joanne deals with issues such as rent review, repairing and other leasehold obligations and business tenancies, whilst in relation to residential landlord and tenant law she acts, for example, on leasehold enfranchisement and service charge disputes.

Recent/notable cases include:

  • Acting for the owners and operators of a wind farm at Deeping St Nicholas in relation to a high profile claim of noise nuisance from local residents (Davis v RC Tinsley Ltd)

  • An appeal to the Court of Appeal in relation to leasehold enfranchisement of a house in Shenley Park, Hertfordshire (Hertsmere BC v Lovat [2011] EWCA Civ 1185)

  • Advising institutional landlords on their obligations under the CRC Energy Efficiency Scheme and their ability to recover costs of participation in the Scheme from their tenants

  • Advising and acting on overage and other disputes arising under agreements for the sale and development of land

  • Advising a utility company which had laid district heating pipes said to be interfering with high voltage electricity cables and gas pipes laid in close proximity

  • A Court of Appeal decision concerning the interpretation of off-plan contracts for sale of apartments in a new development (McGahon v Crest Nicholson Regeneration Ltd [2010] EWCA Civ 842)

  • A £4 million claim for dishonest assistance, breach of confidence and conspiracy arising out of rival bids for Ministry of Defence land

  • Appearing for Yeoman's Row Management Limited at first instance and in the Court of Appeal in the leading case on proprietary estoppel (Yeoman's Row Management Ltd v Cobbe [2006] EWCA Civ 1139; [2006] 1 WLR 2964)
