Insolvency CV

Jonathan's pensions and commercial work often has an insolvency element to it, and he has seen him instructed in relation to the following significant insolvencies, a number of which have been US Chapter 11s:

• Nortel Networks- successfully acted (with Raquel Agnello) for the Pensions Regulator in the landmark Nortel & Lehman v tPR case at first instance; appeared on appeal (judgment awaited). Advising in relation to the role of the pension scheme and regulatory claims in the English insolvency, US Chapter 11 and Canadian insolvency. 
  
  
• Lehman Brothers- advising in relation to the role of the pension scheme and regulatory claims in the English insolvency and US Chapter 11.

• T&N - instructed by PPF in Gleave v PPF (2008) concerning the valuation of contingent debts and the application of the hindsight principle.
  
  
• Sea Containers - instructed by trustees of pension scheme in relation to US Chapter 11, culminated in settlement approved by US bankruptcy court in 2009 and plan of re-organisation.
  
  
• MG Rover- instructed by PPF (with Micahel Tennet QC) to deal with pension claims in the insolvency.
