Judith has specialised in private client matters throughout her career and has valuable experience across a wide range of issues.
Recent examples/notable cases include:
- Acting for claimants, beneficiaries and trustees in several confidential variations of trust applications to partition trust funds, create new tax-efficient interests, and defer vesting of beneficial interests. Recent cases have involved issues about entailed interests, the role of the Court of Protection and the rule against perpetuities.
- Acting for various claimants, defendants and executors in proceedings under the Inheritance (Provision for Family and Dependants) Act 1975 including Fielden v Cunliffe [2005] (short marriage) and Challinor v Challinor [2009] (claim by child).
- Acting for the claimants in a constructive trust claim (Tackaberry v Hollis [2007]).
- Acting for the claimant in a claim for rectification of a will (Goodman v Goodman [2006]).
- Acting for the applicant in Court of Protection proceedings for authority to make gifts and a statutory codicil.
- Acting for beneficiaries in proceedings for the construction of a trust deed of a multi-million pound trust fund.
- Acting for a defendant beneficiary in proceedings about a testatrix's testamentary capacity.
- Acting for the claimant in proceedings for relief from the forfeiture rule.
- Advising a trustee in relation to a claim for secret profits in connection with a multi-million pound trust fund.
- Advising Oxford University on the amendment of its statutes.
- Advising in divorce proceedings on issues of procedure and sham trusts (Charman v Charman [2005] and [2006]).
