Julian has experience of acting in a wide range of commercial disputes.

Recent / notable cases include:

  • Appearing in the House of Lords for the successful appellants in the leading recent case on contractual interpretation and rectification - Chartbrook Limited v Persimmon Homes Limited [2009] 3 WLR 267.

  • Advising and acting for the trustee of an offshore unit trust in a series of related disputes over the liabilities of the unit trust (2009).

  • Advising the lenders in a dispute over the meaning and effect of a series of loan agreements and charges used by the borrower to acquire share capital in a leasing company (2009).

  • Acting for the successful claimant at trial in a claim for the return of shares obtained in breach of fiduciary duty - Cobbetts LLP v Hodge [2009] EWHC 786 (Ch).

  • Regularly advising and acting for firms and LLPs in disputes with partners and former partners, particularly disputes relating to post-partnership restrictive covenants. Julian has advised such clients across a broad range of professions: solicitors, medical professionals, and property professionals.

  • Acting for the successful Claimant in obtaining injunctive relief to prevent interference with a telephone database - Fixtelecom NO Limited v MCI Worldcom AS (2005).

  • Acting in a High Court dispute between two tobacco multinationals over the terms of a trade mark licence for Southern Africa - Philip Morris v Venfin (2004).

  • Acting in arbitral proceedings conducted under ICC Rules in Toronto, Canada concerning a dispute over the licence for the principal patents covering the manufacture and use of polynucleotide arrays, the enabling technology in genetic analysis - Affymetrix v Oxford Gene Technology (2004).
