Property litigation forms the core of Julian's practice and he regularly advises and acts for clients in cases relating to all aspects of landlord and tenant (both commercial and residential); contracts for sale; development contracts; easements and rights; restrictive covenants; and leasehold enfranchisement. Much of his recent work has involved disputes over the meaning of provisions in contracts for the development of land.
Recent/notable cases include:
- Appearing in the House of Lords for the successful appellants in a dispute over the interpretation and rectification of the overage provisions in a development contract - Chartbrook Limited v Persimmon Homes Limited [2009] 3 WLR 267.
- Acting for the landowner in an ongoing dispute over the termination of an agreement for the development of a major site in Scotland (2009).
- Acting for the landlord in a claim for damages for terminal dilapidations in a central London commercial property (2009).
- Appearing in the Court of Appeal on behalf of the appellants in a dispute over the effect of a "virtual assignment" - Clarence House Limited v National Westminster Bank Plc (2009).
- Acting for the defendant vendor in a three-party claim for fraudulent misrepresentation in the sale of commercial property (2009).
- Advising the trustee of an offshore unit trust in a series of related disputes arising out of a substantial liability for unoccupied non-domestic rates on trust property (2009).
- Advising and acting for a major residential developer in a dispute over the meaning and effect of a balancing payment provision and a development agreement (2009).
- Advising and successfully representing on appeal the licensees of two tied public houses in claims for forfeiture brought by their landlord pubcos (2009).
- Advising and acting for a developer in a claim against it for breach of a restrictive covenant in building a prestigious residential development in south west London (2009).
- Advising the landowner in relation to a series of inter-related leasehold enfranchisement claims on a large residential property divided into apartments (2009).
- Appearing for the successful appellant in an appeal relating to the interpretation of section 70(1)(g) of the Land Registration Act 1925 - Bank of Scotland v Qutb [2008] EWHC 1669 (Ch).
- Advising and acting for a major national hotel company in a rent review of a landmark central London hotel (2008).
