Sagicor (Cayman) Ltd v Hurlstone
Tom Lowe QC and Andrew Mold are acting on behalf of the Hurlstone parties in their claim for damages after being subject to a Mareva injunction for the best part of 3 years.
Tom and Andrew defended their clients in the main proceedings against allegations of insurance fraud following construction work arising out of Hurricane Ivan. After a trial before Henderson J in the Grand Court of the Cayman Islands in December 2008, their clients succeeded in their counterclaim and were awarded substantial damages.
The Mareva injunction had been discharged shortly before trial. The current hearing, which will also be before Henderson J, will determine the level of further damages the Hurlstone parties are entitled to and also consider their separate claim for abuse of process.
