Nikki has represented clients in several overseas jurisdictions, such as the Cayman Islands, the Turks & Caicos Islands, the Channel Islands and the Isle of Man in trust and commercial matters and he has substantial experience of providing expert evidence on English law for foreign proceedings. A selection of cases is as follows:
Re ABC Trust [2011]: multi million pound dispute against former trustees for breach of trust in relation to investment policy and conflict of interest.
Re XYZ Trust [2011]: acting for former trustees and trustee company directors defending claims of fraudulent dissipation of trust assets and negligent investments.
Re ABC Bank [2010]: acting for substantial shareholders of a large foreign Asian bank in relation to pre-emption rights and share valuation.
Re SphinX Hedge Funds [2010]: acting for substantial creditor in the wind up of the SphinX hedge funds.
Re Nortel [2010]: expert evidence as to English law for Canadian and US proceedings in the Nortel insolvency.
Jenington v Assaubayev [2010]: international fraud claim of over £200 million, worldwide freezing injunctions, search and seizure orders and disclosure orders.
Reeves v Sprecher [2008] All ER(D) 311: multi-jurisdiction hedge fund dispute between co-shareholders.
The Anders Jahre Estate litigation: complex breach of trust claims in relation to a very substantial Norwegian estate.
Cayman General Insurance Co Ltd & Others v Crawford Adjusters & Others: acting for building contractors in defending fraud claims in the aftermath of Hurricane Ivan.
Re the ABC Trust: represented the Claimant beneficiary in a large family trusts dispute against professional trustee for conflict of interest and exclusion.
Grand Cay Developments Ltd (in liquidation) v Griesel & Others: misfeasance action by liquidators against former directors
Segoes Holdings Ltd v Benbow: acting for the claimant in a dispute over the performance of a share sale agreement.
