Estates Gazette Podcast: S Franses Ltd v Cavendish Hotel (London) Ltd
Joanne Wicks QC and Benjamin Faulkner joined Estates Gazette to discuss S Franses Ltd v Cavendish Hotel (London) Ltd on their latest Property Podcast which was broadcast yesterday, 13 December 2018.
Joanne and Benjamin acted successfully in the Supreme Court for the appellant tenant in arguably the biggest property case of the year. For anyone advising landlords or business tenants in relation to security of tenure under the Landlord & Tenant Act 1954 (“the 1954 Act”) the judgment is a must-read: it introduces a whole new element to the test when establishing whether a landlord has the requisite intention to redevelop under ground (f), which may prove harder for landlords to satisfy. In the podcast, Joanne and Benjamin discuss the court’s decision, what it means for the operation of ground (f) – and how landlords and tenants will be advised going forward.
