Practice overview

Described as “a real star in the making” (Chambers & Partners, 2024), and already ranked as a leading junior in The Legal 500, Daniel has a thriving commercial chancery practice spanning property, commercial, insolvency and trusts disputes.

Daniel frequently appears as sole counsel in both the High Court and the County Court, and is due to appear unled in the Court of Appeal later this year, as well as retaining a focus on drafting and advisory work. Many of Daniel’s cases have an international dimension, and he has experience of ADR procedures, including having been involved in two multi-week arbitrations in 2020 and 2021. He is equally comfortable acting alone or as part of a larger team.

Recently, Daniel has acted for the Ministry of Defence in a major judicial review (Annington Property Ltd v Secretary of State for Defence – one of The Lawyers’ top 20 cases of 2023), an insolvent bank in a £1.3bn fraud claim (Vneshprombank LLC v Bedzhamov), a mayoral development corporation in a six-week High Court trial over rights of way across Europe’s largest brownfield development site (South Tees Development Corporation v PD Teesport Ltd), and four of the Defendants in a fraud claim said to be worth around $1bn (Harrington & Charles Trading Co Ltd v Mehta). In January 2023 he successfully acted as sole counsel for the claimant estate agent in high-profile 6-day trial which received significant coverage in the national press (Rokstone Ltd v Tiggy Butler).

Daniel is described in the directories as being “very clever and hardworking” (Legal 500, 2024), “able to pick up esoteric areas of law very quickly” and “happy to get stuck in and assist wherever a job needs to be done.” (Legal 500, 2023). He has also been praised as a “confident advocate” (Chambers and Partners 2024) and “a strong advocate despite his recent call” (Legal 500, 2024).

Before studying law, Daniel read History at Jesus College, Cambridge and graduated with a starred double first, coming top of his year. He was awarded numerous college and university prizes throughout his degree. He then stayed on at Cambridge to complete an MPhil in Political Thought and Intellectual History as a Goh-Coupe postgraduate scholar at Jesus College, also representing his college on University Challenge that year.

Commercial disputes

Daniel undertakes a wide variety of commercial work, acting both alone and as part of a larger team. He has a particular interest in cases involving allegations of fraud or dishonesty.

Daniel is ranked as a rising star in commercial litigation by The Legal 500, 2024, where he is described as “very clever and hardworking, and a strong advocate despite his recent call”.

Recent examples of relevant experience include:

  • Acting for the claimant in Vneshprombank LLC v Bedzhamov, a £1.3billion fraud claim arising from the insolvency of a Russian bank and subsequent investigation by the Russian (Led by Alan Gourgey KCAndrew Mold KCStephen Brown and Jack Watson).
  • Acting for four of the defendants in Harrington & Charles Trading Co Ltd v Mehta.
  • Successfully (as sole counsel) obtaining security for costs in a contested High Court hearing.
  • Successfully acting (as sole counsel) for the claimant in a 6-day County Court trial of a contractual dispute (Rokstone Ltd v Butler).
  • Advising in relation to the just and equitable winding up of a joint-venture company.
  • Advising on bringing claims against a UK-domiciled parent company for environmental damage caused in a different jurisdiction.
  • Obtaining (as sole counsel) relief from sanctions and permission to defend the enforcement of a foreign judgment on the basis that the judgment may have been procured in circumstances contrary to principles of natural justice (Shamma v Jawad [2022] EWHC 2987 (KB)).
  • Defending a claim for fraudulent misrepresentation in relation to a Share Purchase Agreement for the shares in a Luxembourg financial services company.
  • A High Court trial arising from the dismissal of the founding member of a technology company (Glass v Previse Ltd (2018)) (led by James Bailey KC). Daniel and James acted successfully for the Part 8 Claimant in obtaining a declaration as to the true construction of the defendant company’s articles of association.
  • Advising on the existence of a contract between a vendor and a party not named on the face of the contractual documents, and related issues in the law of agency.
  • Acting in the County Court for a major home improvements retailer in relation to an ongoing contractual dispute.
  • Advising on and undertaking drafting in relation to a claim for termination payments under a series of contracts for the provision of goods and services.
  • Assisting in a three-day hearing in the High Court concerning the continuation of a worldwide freezing injunction and the grant of supporting Norwich Pharmacal and Anton Piller orders (Arcelormittal USA LLC v Essar Steel Ltd [2019] EWHC 724 (Comm)).
  • Assisting in successfully resisting an application for pre-action disclosure in a putative claim for breach of a joint venture agreement.
  • Assisting in advising on the construction of back-to-back indemnities for damages awarded in claims for breach of fiduciary duty and unlawful means conspiracy.

Insolvency

Daniel is often instructed in relation to insolvency and company law matters. He frequently appears in the Company Insolvency List in the High Court, as well as acting in or advising on larger matters both led and unled.

Recent examples of relevant experience include:

  • Acting (led by Ian Rogers KC and Thomas Robinson) for the successful applicants in Re Baglan [2022] EWHC 647 (Ch) – a challenge to a decision by the Official Receiver to disclaim a defunct power station in South Wales.
  • Acting (as sole counsel) in Manning v Neste AB [2022] EWHC 2578 (Ch), the first case to consider a number of important issues under s.245 of the Insolvency Act. Daniel has obtained permission to appeal to the Court of Appeal.
  • Successfully setting aside transactions under s.238 of the Insolvency Act.
  • Successfully obtaining a vesting order under s.181 of the Insolvency Act.
  • Advising in relation to a just and equitable winding up of a joint-venture company.
  • Acting successfully (led by James Bailey KC) in High Court trial concerning the true construction of the defendant company’s articles of association following the dismissal of the company’s founder (Glass v Previse Ltd (2018)).
  • Defending a fraudulent misrepresentation claim arising from the sale of the shares in a financial services company based in Luxembourg.
  • Obtaining and conducting an examination of an insolvent company’s former accountant under s.236 of the Insolvency Act 1986.
  • Bringing proceedings under 238 and 423 of the Insolvency Act 1986.
  • Advising on points of company law in relation to the corporate governance of the freehold management company of a block of luxury flats in Central London.
  • Successfully applying to extend an administration for a third time.
  • Advising on questions of corporate personality in relation to the test for intention under grounds (f) and (g) of the Landlord and Tenant Act 1954.

Daniel accepts instructions in professional negligence claims relating to all of the areas in which he practices.

Daniel is also, along with Michael Tennet KC and Jonathan Hilliard KC, an editor of the chapter on actuaries in Simpson’s Professional Negligence and Liability Looseleaf.

Recent experience includes:

  • Acting as sole counsel for the successful claimants in Rokstone Ltd v Butler, a 6-day trial in Central London County Court involving a substantial counterclaim in professional negligence.
  • Acting for the claimants in a claim arising from the negligent drafting on an option agreement. (Led by Jonathan Seitler KC and Zoë Barton KC).
  • A claim for professional negligence arising from a failure to advise on the planning implications of proposed building works on high-street retail premises (led by Andrew Mold KC).
  • Assisting in defending a multimillion-pound professional negligence claim relating to an alleged failure to advise on rights of light impeding the development of a neighbouring plot of land.
  • Assisting with a number of professional negligence claims against pensions trustees or their advisors.

Examples of recent work as part of a larger team include:

  • R (Annington Property Ltd) & Ors v Secretary of State for Defence & Ors [2023] EWHC 1154 (Admin). One of The Lawyers’ top 20 cases of 2023, Daniel acted – led by Sir James Eadie KC, Joanne Wicks KC, Phillip Rainey KC and Ivan Hare KC – for the Secretary of State.
  • Acting for the Claimants in South Tees Development Corporation Ltd v PD Teesport, a six-week trial about the existence of various easements across Europe’s largest brownfield development site.
  • On Tower UK Ltd v AP Wireless (II) UK Ltd (2022), an important decision on the renewal of a lease of a telecommunications mast under Part II of the Landlord and Tenant Act 1954.
  • Morgan v Egan (2022), a long-running boundary dispute concerning two neighbouring residential properties in Kent culminating in a 7-day trial.
  • Acting in a long-running multi-staged rent review arbitration in relation to an £8 billion property portfolio. This involved a 13-day (remote) hearing in July 2020 and a further 2-week hearing in 2021 involving extensive cross-examination of expert witnesses on questions of valuation, financial modelling and public policy.
  • Defending a complex claim for termination payments under an asset management agreement relating to a £270m property portfolio (led by Joanne Wicks KC and Jonathan Chew).
  • Acting for the claimants in a claim arising from the negligent drafting on an option agreement. (Led by Jonathan Seitler KC and Zoë Barton KC).
  • Advising on the existence of an easement said to have been acquired by way of lost modern grant in favour of a large residential property in South Kensington.
  • A claim to enforce payment of a debt secured on a commercial premise in Newcastle (led by Jonathan Seitler KC).
  • A claim for professional negligence arising from a failure to advise on the planning implications of proposed building works on high-street retail premises (led by Andrew Mold KC).
  • Assisting with a defending a multimillion-pound professional negligence claim relating to the failure to advise on rights of light inhibiting the development of land.

Examples of recent work as sole counsel include:

  • Acting as sole counsel for the successful claimants in Rokstone Ltd v Butler, a 6-day trial in Central London County Court involving a substantial counterclaim in professional negligence.
  • Successfully obtaining a vesting order of a headlease under ss.181-182 of the Insolvency Act 1986.
  • Seeking urgent injunctive relief in relation to a claim for relief from forfeiture of mixed- use premises.
  • Advising on the construction and enforceability of restrictive covenants.
  • Advising on various issues arising from a neighbor dispute, including the availability of injunctive relief in relation to an alleged nuisance, the existence of a piping easement by way of prescription, and an alleged conflict of interest on the board of the freehold management company.
  • Successfully obtaining possession orders in the County Court.
  • Obtaining a final charging order over development land in Essex.
  • Resisting summary judgment on an opposed lease renewal under grounds (f) and (g) of the 1954 Act.
  • Successfully obtaining damages for use and occupation of lands belonging to a golf club in Hampshire.

Daniel also edited “Current Issues in Nuisance and Trespass” (a Wilberforce ebook) with Joanne Wicks KC and Benjamin Faulkner, and frequently speaks on issues in the law of real property and landlord and tenant laws.

Trusts, probate and estates: contentious

Daniel is developing a broad private client practice spanning both contentious and non-contentious matters. He also retains an interest in the intersection between the law of trusts and other areas of law.

Examples of relevant experience include:

  • Advising on undue Influence claims against an Inter vivos transferee of real estate.
  • Advising in relation to a claim for breach of trust against trustees based in the Isle of Man.
  • Advising on the payability of SDLT by public bodies entering into leases for specific purposes.
  • Drafting proceedings against the executor of will.
  • Assisting on a number of cases involving complex questions of international succession law, including cases concerning the existence of a constructive trust over Liberian bearer shares in a Greek company, and conflicting wills in four jurisdictions including Hong Kong and Malaysia.
  • Assisting on the first case in which trustees were granted Beddoe relief to pursue an appeal to the Supreme Court (Airways Pension Scheme Trustee Ltd v (1) Fielder & (2) British Airways Plc [2019] EWHC 29 (Ch)).
  • Assisting with both bringing and defending claims under the Inheritance (Family and Dependants) Act 1975.
  • Assisting in advising on the construction of a trust provision dealing with the distribution of assets following the death of a beneficiary.
