Practice overview

A fantastic senior-junior, Jack is described in the legal directories as “utterly unflappable”, “able to dissemble papers in seconds”, “excellent on his feet” and “deadly on cross-examination” leaving “no stone unturned”. His “ability to get to the heart of complex disputes is very impressive”.

Jack has a busy courtroom based commercial and insolvency practice with particular emphasis on commercial fraud, shareholder disputes, trusts and technical insolvency. In particular, Jack has considerable experience acting in high-value and complex disputes regularly in cases involving an international dimension, often appearing on his own against KCs or senior junior barristers. He has recently appeared unled or leading larger teams both at appellate level in the Privy Council and Court of Appeal and in trials in the Commercial Court, Business and Property Courts as well as the courts of other jurisdictions.

Jack’s recent experience includes:

  • Richards v Bodden: Appearing unled in the Judicial Committee of the Privy Council in a claim for restitution/unjust enrichment arising out of the failure of an instalment contract.
  • Re ipagoo (No.1): Acting as sole counsel for the successful joint administrators in a two-day appeal before the Court of Appeal to determine whether sums held by e-money providers pursuant to the Electronic Money Regulations 2011 are held on a statutory trust.
  • Ridley v DIB: Acting as sole counsel in a four-day commercial court trial seeking injunctive relief in respect of the imprisonment of an individual following an alleged $400m fraud.
  • Re Brickvest (in liquidation): Acting as sole counsel for the Defendants in three-week High Court trial over a £19m claim for unfair prejudice and breach of warranty arising out of the collapse of an investment fund relating to the purchase of land in Germany.

Jack appreciates the importance of giving clear practical advice and rolling up his sleeves to fight hard for his clients.

Jack is a former European Debating Champion and his published written work has been described as ‘illuminating’ in the Privy Council (Paponette v A-G of Trinidad and Tobago [2010] UKPC 32 per Lord Brown) and been cited approvingly by the Court of Appeal for Northern Ireland (Re Loreto Grammar School [2012] NICA 1) and again by the Privy Council (United Policyholders Group v Attorney General of Trinidad and Tobago [2016] UKPC 17).

Commercial disputes

Jack is ranked as a leading junior for Commercial Litigation, Civil Fraud and Commercial chancery and has extensive experience of civil fraud, asset recovery, insolvency and company and partnership disputes as well as associated regulatory and financial services issues. Jack is also presently instructed in relation to a number of unfair prejudice petitions and has particular experience in relation to the overlap between fraud claims and insolvency. He is described in the directories as:

  • “Extremely smart, analytical, decisive as well as being user-friendly and approachable: a great asset to any litigation team.”
  • “Jack can dissemble papers in seconds and deliver completely sound and commercial advice.”
  • He is on top of every detail, utterly unflappable and deadly on cross examination. His written submissions are comprehensive and he leaves no stone unturned. Top marks.
  • “Jack is all over the law but also practical and personable.”
  • “He grasps things so quickly and just knows what you have to do next. Jack goes the extra mile for you and is always at hand.”

Jack’s recent experience of commercial work includes:

  • AHAB v Saad: Acting as junior counsel (with Tom Lowe KC) in one of the largest fraud cases ever litigated, involving a claim for around US$9bn, a trial lasting over a year and the disclosure of over 5 million documents. In addition to complex issues of fact, the case involved issues relating to tracing and asset recovery, trust and partnership law, attribution of knowledge, ex turpi causa, bona fide purchase, conflicts of law and the law of Saudi Arabia, Switzerland and Bahrain. Jack’s involvement included cross examining an expert accountant in relation to a claim to trace over US$150m.
