Ravin Ramkissoon v Estate Management & Business Development Co Ltd

David Phillips QC has successfully resisted a challenge to a Norwich Pharmacal Order that he obtained in Trinidad & Tobago earlier this year. On 29 October 2018 the Court of Appeal handed down a reserved judgment in an application for permission to appeal in Ravin Ramkissoon v Estate Management & Business Development Co Ltd. This was the first occasion on which the Court of Appeal had had occasion to consider the application of the Norwich Pharmacal jurisdiction in Trinidad. The decision endorsed David’s submissions, and adopted the Norwich Pharmacal practice that has developed in England and Wales.
As reported by the Trinidad Daily Express here, Prime Minister of Trinidad & Tobago Dr Keith Rowley has spoken of the significance of the judgment (which can be viewed here); he described the decision as being “a landmark judgment…in…anti-corruption cases” and said that “a major development” had occurred involving “one of the biggest cases” of alleged white collar crime to reach the courts, which had authorised EMBD to “follow the money”.
