Join Stuart Isaacs QC, Stephen Brown and Daniel Scott in a discussion about the impact of the UK’s departure from the European Union on international arbitration in the United Kingdom.

The discussion begins by looking at salient aspects of the Trade and Cooperation Agreement between the United Kingdom and the European Union. It addresses the post-Brexit relationship between the courts of England and Wales, on the one hand, and the courts of the remaining EU Member States, on the other hand, and what has happened since the end of the transitional period on 31 December 2020. It considers the impact on the rules relating to the determination of the governing law of a contract, and the rules which govern the choice of forum and the recognition and enforcement of court judgments.

In the light of the changes brought about, the speakers explain their view that, precisely because arbitration has very largely been kept out of the reach of EU law, Brexit has provided a boost for London-seated international commercial arbitrations and investment arbitrations.
