Case note on Supreme Court decision on the qualifying period for adverse possession (Brown v Ridley)

Tiffany Scott KC has written a case note on Brown v Ridley which has recently been published on LexisNexis.

Practitioners will have had an eye on this case during its journey through the Tribunals. The Supreme Court has provided welcome clarification: clients do not need to jump precipitously into an expensive and acrimonious boundary dispute. Applicants will have time once they discover a boundary issue to take legal advice about the merits of a potential claim, to consider carefully whether the costs of the exercise will be proportionate to the benefits if successful, and to discuss matters with their neighbours and explore alternative dispute resolution.
