For this webinar, we were delighted to be joined by M Scott Donald (University of New South Wales). Associate Professor Scott Donald is Director of the Centre for Law, Markets and Regulation, UNSW Law, UNSW Sydney.

David Pollard joined Scott for this webinar and together they looked at the use of the “prudence” test in pension scheme investment. Often quoted, but little defined.

What legally does prudence mean in investment?

  • Is prudence an implied duty? Is it the right test for pension schemes and commercial trusts? What does it require?

Prudence and XXX risks: Extreme, Exogenous and Existential

  • How far should trustees anticipate and seek to deal with XXX risks? In the light of the Covid 19 turmoil, what are the legal issues for trustees in relation to XXX risks?
