Wilberforce Chambers invites you to a series of lectures by senior practitioners on technical topics of particular interest to non-contentious pensions lawyers. Wilberforce Chambers has a well-established reputation in the field of pensions law, due in large part to the late Edward Nugee QC, to whose memory these lectures are dedicated. The fields to be covered are members’ rights to information, certain complexities in the moral hazard regime, challenges relating to the PPF and trustees’ duties, and DB schemes on the decline curve.

The third lecture in our series is:

PPF entry and employers’ financial distress

  • PPF Entry and “insolvency events”:

– Changes made from June 2017 by the Recast EC Insolvency Regulation

– The disparity between insolvency and insolvency events: beware the administration of the solvent employer

  • Trustees’ powers and duties in restructurings
  • Trustees duties at the end of a scheme’s life- how does the ITS v Hope idea of not taking inappropriate account of the PPF apply where PPF entry is in prospect?
  • Remaining problems on PPF eligibility- recent developments and remaining practical problems
