This session will discuss ‘Negotiating damages and s.84(1) LPA compensation’, covering:

  • How does a claim for an injunction fit with negotiating damages?
  • 5% or 50% – how are they assessed?
  • Is the negotiating damages measure ever relevant when the Upper Tribunal is assessing compensation for covenant modification?
  • Why is the alternative measure of compensation (s.84(1)(ii)) so rarely relied on?
