Wilberforce Chambers is delighted to announce the in-person return of the Nugee Pensions Lectures. We invite you to join our pensions team each week in June as they discuss current topics of particular interest. Wilberforce Chambers has a well-established reputation in the field of pensions law, due in large part to the late Edward Nugee QC, to whose memory these lectures are dedicated. The first lecture of 2022 will look at recent developments in pensions and personal bankruptcy; the second covers the interpretation of pensions scheme documents; the third looks at using old law to solve new problems; and the final lecture will explore European pension schemes in a post-Brexit world and the interaction between Sharia law and occupational pensions.

The third session is entitled ‘Using old law to solve new problems’ by Jonathan Hilliard QC, Thomas Robinson and Sebastian Allen:

  • Dealing with factual uncertainties: the Re Benjamin [1902] 1 Ch 723 jurisdiction. What practical uses can it be put to and how far does it go? 

  • Covering a trustee’s back: Re Beddoe [1893] 1 Ch 547. When is it necessary, when is it unnecessary and what problems arise in practice? 

  • The power of compromise: s.15 of the Trustee Act 1925. The types of compromise and the differences between them.
