Next week, the Supreme Court will hear the appeal of S Franses v Cavendish Hotel (London) Ltd [2017] EWHC 1670 (QB); [2017] EGLR 34 – a major case in respect of the operation of section 30(1)(f) of the Landlord and Tenant Act 1954.
Joanne Wicks QC and Benjamin Faulkner act for the tenant, S Franses, and were granted permission for a leapfrog appeal to the Supreme Court earlier this year. In this Estates Gazette podcast, they describe the case’s journey through the courts so far and explain just why it has attracted so much industry interest – as well as analysing the practical effect of the decision as it stands, and the arguments raised in next week’s appeal.
