Kuehn v Victory Place Management

David Phillips QC has represented the Appellants in their appeal before the Chancellor in Kuehn v Victory Place Management.  The appeal was a challenge by lessees to the management company’s application of a no-pets policy.  As well as its human/canine interest the appeal involved consideration of the extent to which Wednesbury principles should be implied into a long lease as well as the application of those principles to the facts of the particular case.  Judgment has been reserved.  The appeal has attracted considerable public interest – for example https://www.dailymail.co.uk/news/article-5313721/Couple-bitter-dispute-dog-1m-penthouse.html
