Wilberforce features in two of Estates Gazette’s Top 10 Cases of 2022

EG (Estates Gazette) has released its annual podcast, discussing the most significant property law cases of the past year, and we are pleased to announce that Wilberforce members appear in case number 1 and case number 3 on the 2022 list (as well as receiving two additional honourable mentions). This is the third time in four years that Wilberforce has featured in the number 1 case.

Case #1:

Taking the number 1 position is the much-talked-about Covid rent arrears cases of Bank of New York Mellon (International) Ltd v Cine-UK Ltd and London Trocadero (2015) LLP v Picturehouse Cinemas Ltd and others, heard together in the Court of Appeal, involving Jonathan Seitler KC and Benjamin Faulkner.

Case #3:

Awarded the number 3 spot is the first ever telecoms case to reach the Supreme Court: Cornerstone Telecommunications Infrastructure Ltd v Compton Beauchamp Estates Ltd, Cornerstone Telecommunications Infrastructure Ltd v Ashloch Ltd and AP Wireless II (UK) Ltd, and On Tower UK Ltd v AP Wireless II (UK) Ltd, heard together, and involving Jonathan Seitler KC and John McGhee KC.

Honourable mentions:

Bath Rugby Ltd v Greenwood & Ors v Bath Recreation Ltd received an “honourable mention” as it was handed down in late December 2021, after the release of Estates Gazette’s Top 10 Cases of 2021 podcast. This Court of Appeal case concerned the enforceability of a pre-1925 Act restrictive covenant, and featured Martin Hutchings KC and Harriet Holmes.

Rights to Light claim Sirosa Properties Establishment v The Prudential Assurance Company Limited, featuring John McGhee KC, also received an “honourable mention” as it settled.
