Supreme Court allows appeal in Expert Tooling and Automation Ltd v Engie Power Ltd

The Supreme Court has formally allowed by consent the appeal in Expert Tooling and Automation Ltd v Engie Power [2025] EWCA Civ 292 and given judgment for the claimant.

This is a significant development in the field of secret commission claims in the energy field. It means that the customer in this case has received judgment for the full amount of the secret commission paid to the broker.

Thomas Grant KC acted for the claimant in the Court of Appeal, leading Ryan Turner of Maitland Chambers and Professor Paul Davies of Essex Court Chambers.

Stephen Brown acted for the claimant at the first-instance trial.
