Trusts, probate and estates: non-contentious

Much of Roxane’s non-contentious work concerns cross-border matters with Swiss elements. Roxane was called to the Geneva Bar in 2018. She regularly advises on the legal effect of Swiss judgments, marriage contracts and succession agreements in the context of broader litigation or succession planning in England. She also advises on issues of recognition and enforcement of English judgments in Switzerland, mirror orders, disclosure applications/letters of request and injunctive relief in Switzerland.

Roxane’s recent work in this area includes:

  • Advising the wife on financial remedy claims in Switzerland and England, remedies to set aside dispositions to offshore trustees and available injunctive relief in both jurisdictions (assets c. £40m).
  • Advising on the recognition and enforcement of a Swiss order for the sale of valuable artwork located in England.
  • Advising on the legal status of a covenant to make financial provision upon death in an Anglo-Swiss succession dispute involving a Swiss succession agreement.
  • Advising Swiss trustees on strike off and voluntary liquidation of an English limited company held in trust.

Roxane also advises on purely domestic matters such as the proper construction of trust instruments, the scope of trustees’ powers, applications for Beddoe relief and trust restructuring.
