Chancery issues in family proceedings

Roxane regularly acts in financial remedy proceedings (MCA 1973, Schedule 1 and Part III) raising chancery, company and cross-border issues. Roxane’s recent notable work includes:

• Acting (as sole counsel against silk and junior) in a HNW divorce jurisdiction dispute (c. £25m) between England and Switzerland, involving a Swiss post-nuptial agreement, non-disclosure allegations and complex business valuation
• JK v LM [2024] EWHC 1442 (Fam) – Acting (as sole counsel) in a successful High Court application for a freezing order, restriction and legal services order in a Schedule 1 case involving a Czech multimillion-pound trust and dispositions to third parties.
• Acting (as sole counsel) for the intervener in enforcement proceedings arising from a widely reported Part III claim, including securing extensive variation of freezing orders and successfully resisting preservation measures against company assets.
• Advising (with Alice Hawker) on the impact of a financial remedy order on the beneficial ownership of a £45m property in the context of repossession.
• Advising the unmarried partner of an UHNW individual on a variation of a U.S. revocable trust, joint property ownership issues and a deed of covenant making financial provision for her benefit upon death.
• Advising on complex company law undertakings ancillary to a deferred order for sale of private technology company made in financial remedy proceedings.
• Advising the beneficiary of a c. £60m trust on the impact of a proposed trust restructuring on maintenance claims and capitalisation issues.
• Assisting the husband in ongoing U.S. divorce proceedings in securing letters of request seeking evidence in England relating to undisclosed third-party resources and providing expert evidence on English law in the U.S. proceedings.
• Advising on the recognition of a Monegasque child maintenance order and res judicata issues in a UHNW matter (with matrimonial counsel Geoffrey Kingscote KC)
• Advising the husband on the enforcement in England of a Swiss child custody order, and on varying a Swiss maintenance order in a dispute raising complex cross-border issues.

Domestic and offshore matters

• Advising beneficiaries in respect of a trust restructuring (c. £65m.) including a large property portfolio in England and oil and gas companies in Cyprus.
• Representing the minor and unborn beneficiaries in a Public Trustee v Cooper blessing application involving an Isle of Man Trust (c. $25m) and complex U.S. tax issues (with Gilead Copper KC for the executors);
• Advising a former company director on the effect of an order for injunctive relief arising from breaches of confidence and fiduciary duties.
• Advising executors in a will construction dispute involving valuation and tax issues relating of a large art collection.

Swiss matters

• Advice on the impact of a Swiss separate property marriage contract on potential future financial claims in England in a case involving significant pre-marital resources and relocation issues.
• Advising a Singaporean entity on legal challenges to an arbitration award in Switzerland in the context of an ongoing multi-billion investor state claim against Australia.
• Advising Swiss trustees on strike off and voluntary liquidation of an English limited company held in trust.
• Providing expert evidence on financial provision for children in English law for the purposes of divorce proceedings in Switzerland.
• Advice on the recognition and enforcement in England of a Swiss child custody order, and on securing a mirror child arrangements order.
• Advising the executors of an English Estate on the effect of Swiss inheritance contracts in an international succession.
• Advising on the enforcement of a Swiss order for the sale of valuable artwork located in England.
