CIArb EAB Evening Talk: “What No Longer Matters In Light of the ‘FamilyMart / Mozambique’ Cases”

Tom Lowe KC and Tony Ko (Plowman Chambers) are speaking on “What no longer matters in light of the ‘FamilyMart / Mozambique’ cases” at a Chartered Institute of Arbitrators (East Asia Branch) Evening Talk.

The talk will look at the implications of FamilyMart / Mozambique cases for the allocation of disputes to arbitral tribunals. The talk will also look at a line of Hong Kong cases dealing with the approach the Hong Kong Courts take on the question as to how deep the Court would go into the merits of a dispute raised in a bankruptcy/winding-up petition, which is covered by an arbitration agreement, including the Court of Appeal decision in But Ka Chon v Interactive Brokers LLC [2019] 4 HKLRD 85; [2019] HKCA 873.
