Daniel Jukes has written a case analysis for the Butterworths Journal of International Banking and Financial Law on Waller-Edwards v One Savings Bank Plc.
In this important judgment, the Supreme Court has extended the requirements for the Etridge (No 2) protocol to be followed by lenders in the context of non-commercial transactions whereby a loan is advanced to a husband and wife, and as part of the transaction, the wife agrees to stand surety for the husband’s liability for nothing in return. Whilst the court’s approach appears to bring greater certainty, the author argues that the decision does nothing of the sort and amounts to a wrong turn in the law.
